By accessing or using the ZEKE mobile application and related services (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet the eligibility requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Account Registration

To access certain features of the Service, you may need to register for an account. When registering, you agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Content and Conduct

By submitting User Content, you grant ZEKE a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display your User Content in connection with the operation of the Service.

You agree not to use the Service to:

• Post misleading or fraudulent information
• Distribute malware or other harmful code
• Attempt to gain unauthorized access to the Service
• Interfere with the proper working of the Service

5. Health and Fitness Disclaimer

ZEKE provides AI-powered fitness recommendations based on information you provide and our database of studies on physical attractiveness. The Service is not intended to replace professional medical advice, diagnosis, or treatment.

Always consult with a qualified healthcare provider before beginning any exercise program or making significant changes to your diet, especially if you have a medical condition or injury.

6. Subscription and Billing

Some features of the Service may require a paid subscription. By subscribing, you agree to pay the applicable fees. We may change subscription fees from time to time with notice to you. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your app store account settings.

7. Intellectual Property Rights

The Service, including its content, features, and functionality, is owned by ZEKE and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, ZEKE shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of profits, data, or goodwill.

9. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you violate these Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles. Any legal action arising out of or relating to these Terms shall be filed only in the state or federal courts located in San Francisco County, California.
